General Terms of Purchase and Delivery for Fruit Subscriptions
General Terms of Purchase and Supply of Fruit Mix Subscriptions
Fruktkultur, a division of Terrakultur Russia LLC (Fruktkultur), supplies and the Customer pays for the fruit mixes mentioned above on a subscription basis. The fruit mixes shall be supplied weekly, unless otherwise agreed, on agreed days between 08:00 am and 04:00 pm. Fruktkultur supplies year-round from Monday to Friday, except public holidays.
Quality and Complaints
Fruktkultur guarantees that the supplied fruits are of good quality. The fruits in the fruit mixes are handpicked and the fruit that do not meet our high quality demands get sorted out.
If the Customer’s authorized contact person (the Contact Person) is not satisfied with the quality of the supplied fruit mixes she or he shall notify Fruktkultur with the Customer’s complaint at the latest the day after receiving the fruit mixes. In the case of such complaint Fruktkultur should supply new fruit of adequate quality not later than 1 day after the claim (non public holiday day) without any costs for the Customer.
Prices
All the prices for the fruit mix subscriptions excludes VAT. The fruit mix subscriptions may also include loans of baskets for storage of the fruit mix.
Fruktkultur applies a return system for our baskets due to both environmental and economic considerations. In the case that a basket is not returned a fee of 1000-2000 rubles will apply.
Fruktkultur has the right to change the price of the fruit mix subscriptions if necessary due to increased purchase costs, government levies and/or other
external factors. In the case of price changes Fruktkultur will notify the Contact Person in writing via e-mail, fax or mail at least 10 days before the price change becomes effective. If the Customer does not agree to the price change the Customer shall notify Fruktkultur in writing of this and the subscription shall be cancelled without any claims on either party.
Temporary Halt of Supply
The Contact Person may do a temporary halt of supply. The halt of supply must be coherent and should not be for longer than two months. The Contact Person must notify Fruktkultur in writing at least 10 days before the start of the temporary halt of supply. Please note that the temporary halt of supply cannot be used during the notice period.
Cancellation of the Fruit Subscription
The Customer may cancel the fruit subscription at any time and for any reason. The following notice periods are applicable:
1-20 fruit mixes per week: 14 days
>20 fruit mixes per week: 1 month
The cancellation of the fruit subscription shall be made in writing via e-mail, fax or mail. The notice period is counted from the date when Fruktkultur received the cancellation.
Terms of payment
By Invoice within 14 calendar days after invoice receipt, credit card or cash. In the event that the Customer delays payment, it shall be obligated to pay a penalty equal to 0.05% of the delayed amount for each day of delay against the payment term set forth.
